At PointGrip (“PointGrip,” “we,” and “our”), we are committed to safeguarding the privacy of our customers and users (“Customers,” “you,” and “your”) of our PointGrip brand website (the “Site”) and products. This Privacy Policy sets out how we collect and use information from and about you when you visit the Site, including your personal information. By accessing and using the Site, you consent to this Privacy Policy. This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from PointGrip.com (the “Site”). 

1. COLLECTING PERSONAL INFORMATION

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”. 

We collect Device Information using the following technologies:

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”. 

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. 

How do we use your personal information? 

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: 

– Communicate with you; 

– Screen our orders for potential risk or fraud; and 

– When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. 

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

3. YOUR RIGHTS 

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below. 

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States. 

2. INTERNATIONAL PRIVACY LAWS

International data protection laws may give Customers certain rights regarding their Personal Information. 

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your Personal Information under the following lawful bases:

– Your consent;

– The performance of your contract to purchase goods and services from us;

– Compliance with our other legal obligations;

– To protect your vital interests;

– To perform a task carried out in the public interest; or

– For our legitimate interests, which do not override your fundamental rights and freedoms.

If you are located within the EEA or Canada, you may ask us to take the following actions related to your Personal Information:

– Opt-out. Stop sending you direct marketing communications. You may continue to receive service-related and other non-marketing emails. 

– Access.  Provide you with information about our processing of your Personal Information and give you access to your Personal Information.

– Correct.  Update or correct inaccuracies in your Personal Information.

– Delete.  Delete your Personal Information.

– Transfer.  Transfer a machine-readable copy of your Personal Information to you or a third party of your choice.

– Restrict.  Restrict the processing of your Personal Information.

– Object.  Object to our reliance on our legitimate interests as the basis of our processing of your Personal Information.  

You can submit these requests using the contact information at the end of this Privacy Policy. We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. If you would like to submit a complaint about our use of your Personal Information or our response to your requests regarding your Personal Information, you may contact us or submit a complaint to the data protection regulator in your jurisdiction.

(a) Correcting Your Information

Contact PointGrip using the information at the end of this Privacy Policy if you want to access, review, correct or delete the Personal Information collected from you by PointGrip. To protect your privacy and security, PointGrip requires a Customer or User ID and password to verify your identity before granting you the right to access, review, or make corrections to your Personal Information. Please be advised that certain Personal Information may not be corrected or deleted if we must by law retain such information as submitted.

(b) Disclosure of Information

We reserve the right to disclose your Personal Information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order or legal process. 

It is also possible that PointGrip would sell its business (by merger, acquisition or otherwise) or sell all or substantially all of its assets. In any transaction of this kind, Customer information, including your Personal Information, may be among the assets that are transferred. If we decide to transfer your Personal Information, you will be notified by an email sent to the last know email address in our files or by notice posted on the Site.

(c) Retention of Information

We will only retain your Personal Information for as long as necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

When we no longer require the Personal Information we have otherwise collected about you, such as when you cease to be a registered Customer, we will dissociate such identifying information from the Personal Information attached to your content to the extent possible while retaining such information only so long as needed to comply with business, legal or regulatory obligations and requirements. In some circumstances we may anonymize your Personal Information (so that it can no longer be associated with you), in which case we may use this information indefinitely without further notice to you.

(d) International Transfers of Information

Customers located outside of the United States, including all Customers located in the EEA and Canada (“International Users”), are hereby notified that their Personal Information may be collected, used, disclosed, transferred and stored in the United States. By accepting this Privacy Policy, International Users consent to the collection, use, disclosure, transfer, and storage of their Personal Information in the United States for the purposes stated in this Privacy Policy. Personal information of International Users will be subject to lawful access requests from U.S. governmental agencies for as long as it is stored in the United States.

For Customers residing in the EEA, whenever we transfer your Personal Information to the United States, or other countries not deemed by the European Commission to provide an adequate level of personal data protection, the transfer will be made:

– Pursuant to the recipient’s compliance with current Standard Contractual Clauses adopted by the European Commission or Binding Corporate Rules; or

– Pursuant to the consent of the individual to whom the Personal Information pertains; or

– As otherwise permitted by EEA law.

Personal Information processed for us by Shopify will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. 4. COOKIES

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the Site to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use a website, for instance whether it’s their first time visiting or if they are a frequent visitor.

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

5. CUSTOMER CONSENT, CHANGES

If you acknowledge that you have reviewed this Privacy Policy and accept its terms when registering to use the Site or otherwise, then you have expressly consented to the use of your Personal Information as stated in this Privacy Policy. You may withdraw your consent to the use of your Personal Information, unless you are doing so to avoid a legal obligation to PointGrip. PointGrip’s continued use of your Personal Information, after you withdraw your consent to its use, may be required for PointGrip to comply with federal and state laws and regulations.

We will change this Privacy Policy periodically. The date at the end of this Privacy Policy indicates when the most recent changes to this Privacy Policy were posted. By using this Site after any changes to the Privacy Policy become effective, then you are expressly consenting to the use of your Personal Information as stated in this Privacy Policy. We recommend you check this Privacy Policy periodically for changes.
